Can I Be Discriminated Against For Filing Bankruptcy?

The short answer to this question is NO. Pursuant to 11 U.S.C. sec. 525 s governmental units and private employers are prohibited from discriminating against you because you filed a bankruptcy petition or because you failed to pay a dischargeable debt. However, because it does go on your credit, it may feel as if you are being discriminated against because your interest rate options will be inflated, and your requirement to pay higher security deposits will be requested. Believe it or not, if you have really poor credit, filing bankruptcy may actually help your credit. For more information on bankruptcy and how it can affect other areas of your life you can meet with the attorneys at Schwam-Wilcox & Associates.
