Driving while license suspended or revoked

Driving while license suspended or revoked

Having one’s driving privileges suspended or revoked can be a heavy burden on one’s lifestyle. If you are unable to drive, everyday tasks become insurmountable and sometimes impossible. Some counties have no means of public transit which can leave a person with little to no options.

There are numerous reasons for which one’s driver’s license can be suspended or revoked. These reasons include but are not limited to: failure to pay traffic fines, failure to pay judgments, failure to pay child support, failing to appear in court, sustaining convictions for crimes such as theft, drugs or prostitution or being charged with driving under the influence. If you are stopped for driving while your license is suspended or revoked, and you did not have knowledge of the suspension, you will be cited for a moving violation which is a civil offense. However, if you do have knowledge, or should have had knowledge, you will be charged with a criminal offense for which you MUST appear in court, and you can be sentenced to jail.

A first conviction of driving while your license is suspended or revoked is a second degree misdemeanor and punishable by up to sixty (60) days in the county jail. A second conviction is a first degree misdemeanor and is punishable by up to twelve (12) months in the county jail. A third or subsequent conviction for driving while license suspended or revoked is a third degree felony which is punishable by up to five (5) years in Florida State Prison. Such convictions carry heavy fines and can also affect your auto insurance premiums. If you receive three (3) criminal OR civil infractions within a five (5) year period you will become classified as a Habitual Traffic Offender and your driving privileges will be revoked for five (5) years.

One may become eligible for a hardship license only under certain circumstances and after completing particular requirements such as paying numerous fines, taking classes and sitting for examinations.
